I comply with the General Data Protection Regulations (GDPR) and the PSI Guidelines (2022) for Confidentiality and Record Keeping in Practice.

Why Your Data is Collected 

• To provide psychological assessment and treatment.
• To communicate with you regarding appointments.
• To comply with legal and professional obligations (e.g., tax records, clinical safety).

The Legal Basis for Processing
Under GDPR, your data is processed based on:

• Contract: To provide the psychological service you have requested.
• Legal Obligation: To maintain records for Revenue or professional regulators.

Data that is Collected

• Personal details: Name, date of birth, address, and contact information.
• Clinical information: Health history, session notes, and assessment results.
• Third-party info: Referral letters from your GP or consultant (if relevant).

Safe Storage: Your computer data is stored securely using GDPR-compliant Google Workspace, which is configured with two-factor authentication and encryption. 

Any paper records are securely stored in a filing cabinet in my office.

Retention: In line with clinical guidelines, adult records are typically retained for 7 years after our last contact. Records for minors are kept until they reach age 25.

Your Rights: You have the right to access a copy of your data, correct inaccuracies, request its deletion (subject to clinical retention laws), and lodge a complaint with the Data Protection Commission (DPC) Ireland.

Confidentiality and Emergency Protocol

Confidentiality and its Limits

Everything discussed during our sessions is kept confidential. However, under Irish law and professional ethics, I am obliged to break confidentiality in certain situations:

• If there is a serious risk of harm to yourself or others.
• If there is a concern regarding the welfare of a child (under the Children First Act 2015) or vulnerable adult.
• If compelled to disclose information by a court of law.

Emergency Procedures for Online Sessions

Secure video is used for online sessions (Google Meet). I adhere to the PSI Guidelines (2020) on the Use of Online or Telephone Therapy and Assessment.

We agree to the following protocol to ensure your safety:

• Location Verification: At the start of each session, you agree to confirm your current physical address (if different from that provided on intake form).
• Technology Failure: If our connection is interrupted and cannot be restarted within 5 minutes, I will attempt to contact you via your provided phone number.
• Clinical Crisis / Safety Plan: If I become concerned about your immediate safety, you authorise me to contact:
  • Designated Next of Kin and /or Local GP (details provided on your intake form)
  • Emergency Services (999 or 112) or the local Garda station if there is an immediate risk to life.

Working with Vulnerable Adults

When working with vulnerable adults, every attempt will be made to support their understanding of the assessment and intervention process, including use of easy read consent forms where appropriate. A ‘goodness-of-fit’ model of informed consent is used, tailored to the adult’s cognitive abilities and decision-making capacities. Careful attention will be paid to both verbal and non-verbal indicators of non-consent throughout sessions.
